READ CAREFULLY! This LazyCam CNC for Windows End-User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity known as "Customer") and ArtSoft Software Corporation. By installing, copying, or otherwise using the Software or any Software Updates, Customer agrees to be bound by the terms of this Agreement. If Customer does not agree to the terms of this Agreement, do not install, copy, or use the Software, including all Software Updates that Customer received as part of the Software (each, an "Update"). By installing, copying, or otherwise using an Update, Customer agrees to be bound by the additional license terms that accompany such Update. If Customer does not agree to the terms of the additional license terms that accompany the Update, disregard the Update and the additional license terms that accompany the Update. In this event, Customer's rights to use the Software shall continue to be governed by the then-existing Agreement. 0-0) This documents intent and function is to inform the user that NO legal liabilities exist for the use of this software. Using any CNC machine is , at best, a hazardous operation. All safety precautions must be taken as machines can come to life at any time, software CAN malfucntion at any time, any user of the LazyCam software must understand and respect this, and must delete the software immediately and not continue with installation unless they fully understand all implications of use, and the fact that no legal recourse exists in the case of wrongfull use, improper code, unexpected movement, or any damage caused by the afore mentioned effects. 0. Useage limitations A user may, for his own personal use , use the software license for LazyCam on as many computers as he owns and thereby drive as many machines as he owns. In a comercial environment, each machine must have its own license key file. A license may be used to activate the program for simulation use (not driving a machine) on as many computers as the registrant owns regardless of whether it is used in a commercial environment or not. 1. Copyright All title and copyrights in and to the Software (including but not limited to any software components, product documentation and associated media, sample files, extension files, tools and utilities, miscellaneous technical information, collectively referred to herein as the "Software"), and any copies of the Software, are owned by ArtSoft. The Software is protected by Canadian copyright laws and international treaty provisions. Therefore, you must treat the Software like any other copyrighted material. The Software is licensed, not sold. 2. Grant of License a. ArtSoft Software grants Customer a non-exclusive, worldwide license to use ArtSoft's Windows computer software (the "Software") for the purpose of CNC machining or stepper motor control. b The customer will indemnify, hold harmless and defend ArtSoft from and against any claims or lawsuits, including attorney's fees, that arise or result from the use of this software. c. The customer will not allow this software to be run by any person that has not had sufficient training in the use of the software. This training will be provided by the customer for future users. d. Customer may permanently transfer all of Customer's rights under this Agreement, provided Customer retains no copies, Customer transfers all of the Software (including all component parts, the media and printed materials, any upgrades, and this Agreement), Customer provides ArtSoft notice of Customer's name, company, and address and the name, company, and address of the person to whom Customer is transferring the rights granted herein 4. Termination a. Without prejudice to any other rights,ArtSoft may terminate this Agreement if Customer fails to comply with the terms and conditions of this Agreement. In such event, Customer must destroy all copies of the Software in any form and all of its component parts. 5. Canadian Usage. Users agree that this software may not be used within Canada unless purchased from a Canadian supplier or ArtSoft is notified. Should the software be purchased outside Canada and used within Canada, users are required simply to notify ArtSoft of its use within Canadian borders. 6. Disclaimer of Warranty a. NO WARRANTIES. THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Mach2 DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY AGAINST INFRINGEMENT, WITH REGARD TO THE SOFTWARE. b. NO LIABILITY FOR DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AUTHOR BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF THE AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CUSTOMER ACKNOWLEDGES THAT CUSTOMER HAS READ THIS AGREEMENT, UNDERSTAND IT AND AGREES TO BE BOUND BY ITS TERMS AND CONDITIONS. CUSTOMER FURTHER AGREES THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN CUSTOMER AND AUTHOR WHICH SUPERSEDES ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN CUSTOMER ANDTHE AUTHOR RELATING TO THE SOFTWARE.
